1. PREAMBLES
1.1 Usage of this website is on condition that you accept without variation. The terms and conditions set out herein which Marina Island Pangkor Group may vary from time to time at its sole discretion with/without notice to you and you acknowledge that the usage of this website constitutes your agreement to all the terms and conditions in force for the time being as set out herein.

1.2 Following the port circular No. 13/2024 dated 7 August 2024, commencing from 1 January 2025, Jabatan Laut Malaysia (Malaysia Marine Department) will fully commence the implementation of the passenger’s name list for boat licensed to ensure that in the event of any accident at sea, further action and accurate information can be obtained. Thus, passengers are required to provide the full and correct personal information as requested while buying the ferry ticket to ensure that the boat/ferry licensed operator is complied with the Section 474(2) of the Merchant Shipping Ordinance 1952 of which failure of the the boat/ferry licensed operator to comply with this requirement may be subject to a fine not exceeding RM10,000.00.

1.3 You are required to provide your consent to the processing of your personal data as described in the Data Protection & Disclosure. In the event that you do not agree to the Terms & Conditions and the Data Protection & Disclosure stated herein, kindly do not access and/or use this Site and/or its Services.

1.4 If you are under the age of 18 or are below the legal age for giving consent pursuant to the applicable laws in your country, you must first obtain permission from your parent(s) or legal guardian(s) before you access the Site. If you are the parent or legal guardian of a minor who is creating an account on the Site, you are required to accept and comply with these Terms & Conditions on the minor’s behalf and you will be held fully responsible for the minor’s actions, any charges associated with the minor’s use of the Site or purchases made on the Site. If you do not have consent from your parent(s) or legal guardian(s), you must stop using and/or accessing this Site.

1.5 In the Terms & Conditions: “we” or “us” or “Pangkor Ferry.com” means Marina Island Pangkor Group of Companies (including, where appropriate, our employees, agents, and suppliers and all relevant insurers); “you” or “guests” means any and all person(s) for whom a ticket(s) is booked.

1.6 All passengers who purchased ferry ticket(s) to depart and/or arrived at Marina Island Jetty Complex, to use our ferry services shall be deemed to be able to use the facilities managed by Marina Island Pangkor Group of Companies.

1.7 The following terms and conditions create a legally binding agreement between you and Marina Island Pangkor Group of Companies.

2. USE OF THIS SITE
2.1 Marina Island Pangkor Group of Companies permits you to use the Site and its Services subject to the terms & conditions listed herein.

2.2 Marina Island Pangkor Group of Companies may, at any time, and without giving any reason or prior notice, upgrade, change, suspend or discontinue the provision of or remove, whether in whole or in part, the Site and/or any Services and Marina Island Pangkor Group of Companies shall not be liable if this prevents you from accessing the Site and/or any part of its Services.

2.3 Marina Island Pangkor Group of Companies makes no representation about the suitability, accuracy and reliability of the contents, information and services contained on this Site for any purpose. All contents on this Site are provided without warranty or guarantee of any kind. Marina Island Pangkor Group of Companies does not accept or assume any responsibility or liability for any errors, omission or statements whether misleading or otherwise on the Site, whether provided by Marina Island Pangkor Group of Companies or by any other organization, company, individual or entity.

2.4 You shall agree that you will use the Site to make legal purchases/orders and shall not access the Site for any fraudulent or illegal purpose(s) or making any false order(s). If such fraudulent activity(ies) are discovered, Marina Island Pangkor Group of Companies may cancel or suspend any related order(s)/purchase(s) made on the Site without compensation or damages to you and shall report such activities to the relevant authorities at your cost.

2.5 In addition to providing ticket(s) and schedule information, this Site will also contain information on our loyalty programme and any gifts redemption availability. Other ancillary or add-on items, products and/or services such as travel insurance, merchandise and privileged travel e-card may be provided and available for purchase upon confirmation or announcement by Marina Island Pangkor Group of Companies.

2.6 By using this Site, you undertake that you shall not intentionally bring or introduce any viruses, worms, Trojan Horses, spyware, adware and ransomware to attack the Site. In the event of your failure to comply with this term and/or precautions, Marina Island Pangkor Group of Companies reserves the rights to revoke your access to the Site immediately, and to take appropriate actions to claim compensation and damages from you.

2.7 You shall access and use this Site and the Services at your own risk and precaution and Marina Island Pangkor Group of Companies shall not be responsible or liable for any loss or damages suffered and/or to be suffered by you incurred therefrom.

2.8 Conflict between English text and other language text – if there is any conflict or discrepancy between the English text of terms and conditions of this Agreement and any translation thereof, the English text shall prevail.

3. LINK TO THIRD PARTY WEBSITES
3.1 This Site may contain hyperlinks to other websites other than those operated by Marina Island Pangkor Group of Companies and/or its related or associated companies. This does not signify any endorsement, representation or guarantee of any kind by Marina Island Pangkor Group of Companies. Marina Island Pangkor Group of Companies is not responsible and have no control of the content of those websites and is not liable for any errors, omissions, delays, defamation, libel, slander, falsehood, obscenity, pornography, profanity inaccuracy, unreliability and/or other objectionable materials or contents under those websites.

3.2 The various linked sites on our Marina Island Pangkor Group of Companies site allows for further link-up and interaction between you and the said sites for promotions and other interactive mediums. The inclusion of all website links on our Marina Island Pangkor Group of Companies site does not imply endorsement by Marina Island Pangkor Group of Companies of such linked sites, or any association with its operations. Marina Island Pangkor Group of Companies of Companies is not to be held responsible to either the said sites or you assessing the said linked websites, and is further not responsible for the content of the said linked sites, and does not make any representations regarding the content or accuracy of materials on the said site.

3.3 It is your sole responsibility to ensure whatever hyperlinks that you have selected are free of viruses and malware. Therefore, you are advised to examine and assess carefully the security and the terms and conditions contained in those third-party websites.

4. TERMS AND CONDITIONS OF CARRIAGE AND/OR FERRY
4.1 Any booking on the Site is not guaranteed and will be subjected to availability. Punctuality of carriage and/or ferry departing from the either jetty at Marina Island or jetty at Pangkor Island may be affected by water tides, weather condition and/or any condition(s)/ circumstance(s) that is beyond the control of carriage and/or ferry operator.

4.2 The latest carriage and/or ferry schedule (from Marina Island jetty to Pangkor Island jetty or from Pangkor Island jetty to Marina Island jetty) and the terms and conditions are displayed at the ticketing counter and www.pangkorferry.com.

4.3 It is compulsory for passengers to book the date & time for a round trip. Kindly note that the return ticket(s) is only valid for 30 days from the date of the ticket issued at the departure terminal. (Once purchased online, ticket(s) cum boarding pass will be emailed to the purchaser).

4.4 The ticket(s) will be void if:-
a. any change(s) is made to the booking date or time manually; or
b. the passenger had missed the scheduled ferry session booked.

4.5 Marina Island Pangkor Group of Companies or its management reserves the rights to refuse carriage and/or ferry if we determined that:
a. it is necessary for safety reason;
b. it is necessary to comply with any applicable laws or relevant authorities;
c. the ticket is obtained through illegal or fraudulent means;
d. payment for the trip is incomplete or not fully paid;
e. passenger’s actions or passenger’s personal belongings might cause harm to other passengers; or
f. late check in by passenger.

4.6 Passengers are required to arrive at the departure jetty at least 60 minutes and check in at least 15 minutes, before the scheduled departure time. Failure to do so will result in cancellation of booking or purchase, at the cost and expenses of the passengers. Marina Island Pangkor Group of Companies and its management shall not be held responsible or liable should the passenger(s) missed to board the ferry or is refused to board the ferry due to late check in.

4.7 Marina Island Pangkor Group of Companies shall not be responsible for any stolen, lost, damaged or destroyed ticket(s) and no refund will be entertained for any of these reasons. A fresh ticket(s) shall be re-purchased by the passenger at the passenger’s own cost.

4.8 The time(s) of departure and/or arrival printed on the ticket(s) is not guaranteed. The said schedule(s) may be delayed, cancelled or rescheduled at any time and from time to time without prior notice due to circumstance(s) that is beyond the control of Marina Island Pangkor Group of Companies or the carriage and/or ferry operator(s), including but not limited to weather, water tides, technical, lockdown or control movement order or restriction by the government or the relevant authority.

4.9 Marina Island Pangkor Group of Companies, carriage and/or ferry operator(s) and/or jetty management is/are not responsible for the change(s) of trip(s), delay(s) and/or insufficient seat(s) due to unforeseen circumstance(s) or circumstance(s) beyond control such as lockdown or inability for the jetty facility(ies) to operate due to reason beyond party’s control, and in such event, purchased ticket(s), fees and charges are not refundable/ replaceable and Marina Island Pangkor Group of Companies is not responsible for any incidental costs or damages due to such change(s), delay or inability/ restriction to operate.

4.10 The ticket(s) is not transferrable and is only valid for the trip, date and time as stated on the ticket, in favour of the designated passenger printed or contained in the purchased ticket(s) emailed to you. Once purchased, the date and time for the ferry cannot be changed or modified by you. Ticket holders must board the ferry on the specified date and time of departure stated on the ticket(s). Marina Island Pangkor Group of Companies will not allow refund for used or expired ticket(s).

4.11 Marina Island Pangkor Group of Companies reserves the rights to change the fare prior to the commencement of the trip. Marina Island Pangkor Group of Companies may at its sole and absolute discretion refuse transportation or carriage and/or ferry if the fare is not fully paid by passenger(s). Only valid and fully paid ticket holders are allowed to board the carriage and/or ferry.

4.12 Passenger must retain the ticket(s) at all times while on board the ferry and at the terminal for inspection and verification purposes.

4.13 Passengers shall undertake that they shall not pose any safety risk to either themselves or to others. They shall adhere to all relevant standard operating procedures and house rules relating to public safety and security precautions, Covid-19, other viruses and/or dangers of whatsoever kind, as implemented and/or may be implemented by Marina Island Pangkor Group of Companies, relevant authorities and/or jetty management at all times.

4.14 Passengers are solely responsible over their own health, safety and security during the travel. Marina Island Pangkor Group of Companies, its management, carriage and/or ferry operator(s) and jetty management shall not be held responsible or liable for any loss, damages, deaths, injuries and/or virus infections occurred during the travel, carriage or transportation. Passengers are responsible and advised to obtain their own valid travel insurance to cover for any personal accident, damage to personal belongings or trip cancellation. Passengers are responsible for their own travel insurance if required by the passengers.

4.15 Passengers must ensure that the belongings that they brought on board shall be free from defect, and shall be safe and suitable for carriage and/or ferry. Passengers should not carry illegal drugs, pets or other prohibited or illegal materials when boarding. Passengers shall be solely responsible for any damage which they caused to the other passenger(s).

4.16 In certain situations, for safety or security reasons, Marina Island Pangkor Group of Companies or its authorised management may conduct a search on passengers’ personal belongings for any prohibited or illegal materials. Marina Island Pangkor Group of Companies shall not be held liable or responsible for any damage caused to you and/or your personal belongings during such search.

4.17 Passengers shall assume their own risk when they are on board and bringing their personal belongings along. Marina Island Pangkor Group of Companies shall not be held responsible for any loss or damage to the personal belongings.

4.18 Passengers with disability are allowed to bring their wheelchair into the ferry at own risk. It is advisable for passengers on wheelchair to travel with a companion or guardian.

4.19 Marina Island Pangkor Group of Companies may at its sole and absolute discretion vary any terms and conditions and/or the carriage and/or ferry schedule(s) without prior notice and without your prior consent.

4.20 If any of the terms, conditions and provisions contained in this Terms & Conditions shall become or be declared invalid or unenforceable by any court or tribunal of competent jurisdiction, such invalidity or unenforceability shall not affect the remaining terms, conditions and provisions all of which shall remain in full force and effect.

5. TICKET PRICE AND PAYMENT
5.1 The price of the ticket(s) is as stated on the Site from time to time. Prices are subject to changes at any time at the sole and absolute discretion of Marina Island Pangkor Group of Companies or its management.

5.2 Ticket(s) are exempted from Sales and Services Tax (subject to change or directive from the government or the relevant authority from time to time).

5.3 Ticket(s) is free for children below three (3) years old which is without a seat. The name of child or children travelling together with the passenger must be declared as part of the purchasing process.

5.4 Payment for all orders must be made in the manner as set out on the checkout page. Marina Island Pangkor Group of Companies accepts payment by most major credit and debit cards.

5.5 You should be aware that online payment transactions are subjected to validation checks by your card-issuer and Marina Island Pangkor Group of Companies are not responsible for any delay or failure to process your purchase if your card issuer declines to authorise payment for any reason. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee and Marina Island Pangkor Group of Companies will not be responsible for such fees and charges.

5.6 Online administration fee of 15% each of the ticket(s) price will be charged for ticket(s) purchased.

5.7 Additional or add-on item(s), product(s) and/or service(s) will be incurred for administrative charges or processing fees as may be imposed by Marina Island Pangkor Group of Companies or its management from time to time, and such charges and fees shall be paid by you upon confirmation of booking/ purchase.

5.8 All purchases will be transacted in Ringgit Malaysia (RM).

6. CONFIRMATION
6.1 You are responsible to make sure the selection on travelling date, time and destination are correct before making payment at our Site.

6.2 Upon purchasing these e- ticket(s) from www.pangkorferry.com, you agreed to subscribe and give consent to receiving newsletters, notices, information or marketing materials via emails/ WhatsApp/ SMS/ other social media forms, from Marina Island Pangkor Group or its management, however, you may opt not to or unsubscribe the marketing emails by emailing to unsubscribe@pangkorferry.com.

7. RETURN, REFUND AND MODIFICATION POLICY
7.1 You are responsible to make sure the selection on travelling date, time and destination is correct before making payment at our Site.

7.2 If you have received ticket(s) which does not match those ordered, you should contact us at helpdesk@pangkorferry.com within five (5) working days.

7.3 Refund and cancellation are not allowed and/or possible once the purchase transaction is successfully generated with valid ticket(s).

7.4 If you fail to check in or board on time, you will still be charged the entire full amount, your ticket(s) is considered used and becomes invalid/expired. A new ticket(s) is to be purchased by you in order to board the carriage and/or ferry.

7.5 Ticket(s) are non-refundable & not replaceable if it is damaged, lost or the ticket(s) holder had missed the booked schedule time.

7.6 At all times, Marina Island Pangkor Group reserves the rights to cancel and/or reschedule any departure without consent from passengers. Marina Island Pangkor Group shall not be held responsible for any costs or penalties related to accommodations, other travel costs incurred and/or any other losses/ damages as a result of such cancellation and/or reschedule.

7.7 Any changes and/or modification with regards to the ticket(s) date, category and any other details MUST be done/made two (2) working days before your scheduled check-in date. Administration and/or processing fee of RM5.00/ticket for any changes and/or modification will be charged to you.

7.8 For any request of changes and/or modification of the ticket(s) less than two (2) working days before your scheduled check-in date will not be entertained.

8. INTELLECTUAL PROPERTY RIGHTS
8.1 All intellectual property rights, registered or unregistered, on this Site, including but not limited to text, graphics, software, photos, illustrations, artwork, names, logos and trademarks belong to Marina Island Pangkor Group and are protected under copyright laws in favour of Marina Island Pangkor Group.

8.2 No parts contained in this Site shall be reproduced or republished in any manner or by any means without prior written permission of Marina Island Pangkor Group. Nothing contained in this Site shall be deemed as granting license or any rights to use any intellectual property rights without written permission of Marina Island Pangkor Group.

9. TRADEMARKS, ETC
9.1 The material on the www.pangkorferry.com website is the property of Marina Island Pangkor Group. You may download or use the material on the website for your own non-commercial and private use. Otherwise, the material may not be reproduced, published, distributed, amended, downloaded or otherwise used unless you have obtained Marina Island Pangkor Group’s prior permission in writing.
9.2 All trademarks, marks, materials used on the www.pangkorferry.com website directly linked and associated to the Marina Island Pangkor Group are owned by Marina Island Pangkor Group.

10. LIMITATION ON LIABILITY AND LAW
10.1 In no event shall Marina Island Pangkor Group and/or its directors, employees, shareholders or agents:
a. Be liable in respect to the use of the Site, the materials contained in the Site (including without limitation any damages caused by or resulting from reliance by a user on any information obtained from Marina Island Pangkor Group), or any damages that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of gods, communications failures, theft, destruction, or unauthorized access to Marina Island Pangkor Group’s records, programs or services; and

b. be liable for any indirect, special, incidental, consequential, punitive or exemplary damages, including, without limitation, damages for loss of goodwill, lost profits, loss, theft, or corruption of user information, or the inability to use the Site or any of its features.

10.2 We are only responsible for your ticket(s) purchased and guarantee the same on the date as per the reservation made by you.

10.3 We are not in a position to guarantee your safety against accidents, death, acts of God, flood, riot, theft, or even acts of negligence. All activities have inherent risks to health and safety and Marina Island Pangkor Group will not be responsible for any eventualities related to services booked through this site.

10.4 Whilst we make every effort to ensure that the material contained on the pangkorferry.com website is accurate, and all material published is in good faith, Marina Island Pangkor Group does not warrant or represent its accuracy and disclaims to the maximum extent permitted by law all warranties expressed or implied by statute, custom or usage relating to the information contained in the Site. Marina Island Pangkor Group will not be liable for any direct, indirect, consequential losses or damage arising out of the use of this site or any errors, inaccuracies or omissions in materials provided.

11. FORCE MAJEURE
11.1 Marina Island Pangkor Group shall not be held responsible or liable for any delay, reschedule, inability to operate, non-compliance, loss and/or damages as a result of any force majeure event or any event beyond its reasonable control including but not limited to bad weather, epidemic, pandemic, war, riot, earthquake, unexpected legislation, lockdown or strike. In such event, Marina Island Pangkor Group shall undertake reasonable efforts to ensure that their operations are resumed as soon as practicable under the circumstances.

12. GOVERNING LAW AND JURISDICTION
12.1 This terms and conditions as may be imposed by Marina Island Pangkor Group shall be interpreted and governed by the laws of Malaysia.

12.2 You accept and agree to submit to the exclusive jurisdiction of the courts of Malaysia in respect of any dispute or claim relating to these terms and conditions as may be imposed by Marina Island Pangkor Group.

13. DATA PROTECTION AND DISCLOSURE
13.1 We will retain all personal information which you provide during purchased. We may need to pass this information to other parties such as our licensees and it may also be required to be provided to security and/or credit checking companies, credit and debit card companies, government and enforcement agencies and public authorities if so required, or as required by law.

13.2 You consent to the disclosure of your personal information to us. We shall be entitled to disclose and you irrevocably consent to our disclosure of any information pertaining to you to such extent as we may at our sole and absolute discretion deem fit to any security and/or credit checking companies, credit and debit card companies, regulatory bodies, government and enforcement agencies and public authorities if so required, or as required by law; our franchisees, our branches, related corporations, associates, subsidiaries, affiliates, assignees, proposed assignees, agents, commercial partners, service providers and/or any other parties engaged by us to enable or assist us in the provision of services or to exercise or enforce our rights hereunder and/or any other party whomsoever as we may, at our sole and absolute discretion, deem fit.

13.3 Any disclosure by us of the information referred to in this provision will not render us liable to you for any claim, loss, damage (including direct or indirect damages or loss of profits or savings) or liability howsoever arising whether in contract, negligence, or any other basis arising from or in relation to:
a. the release or disclosure of the information by us; and/or
b. the information being incorrect, erroneous or misstated; and/or
c. reliance on the information, whether caused by us or other third party’s omission, misstatement, negligence or default or by technical, hardware or software failures of any kind, interruption, error, omission, viruses, delay in updating or notifying any changes in the information or otherwise howsoever.”

14. COVID-19 AND MOVEMENT CONTROL ORDER (MCO) OR SUCH OTHER RESTRICTIONS IMPOSED BY LOCAL AUTHORITY(IES)
14.1 You shall comply with all the standard operating procedures imposed and/or to be imposed by the government and/or local authority(ies) and/or our management from time to time in relation to the measures or precautions to combat Covid-19 and/or due to the implementation of the MCO or such other restriction(s) in whatsoever description.

14.2 You hereby confirm that you had completed Covid-19 vaccination (or such vaccination program) approved by the local government authority no less than 14 days (for 2-dose vaccine) or 28 days (for 1-dose vaccine) prior to the date of travel. You shall be responsible for your own risk during the travel and shall submit the travel permit, vaccination certificate, health test report and/or such other relevant documentation as may be required by the management.
